Terms & Conditions
Effective Date: January 1, 2026
1) Eligibility
You must be at least 13 years old to use the Site. If you are under 18, you represent that you have permission from a parent or legal guardian.
2) Accounts
If you create an account, you agree to provide accurate information and keep your login credentials confidential. You are responsible for activity under your account.
3) Products, Descriptions & Availability
We sell apparel and accessories. Photos and colors may appear differently depending on lighting and device display; fit and sizing may vary by style and production tolerances. Inventory may be limited — we may limit quantities, refuse orders, or discontinue products at any time.
4) Pricing, Taxes & Payment
Prices are shown in USD unless stated otherwise. Taxes (if applicable) are calculated at checkout. Payments are processed by third-party payment providers; we do not store full payment card details.
5) Order Acceptance
Your order is an offer to purchase. We may accept, refuse, limit, or cancel orders at our discretion (including for suspected fraud, errors, inventory issues, or shipping restrictions). If we cancel an order after payment, we will issue a refund to the original payment method.
6) Processing Times
Unless otherwise stated on the product page, orders are processed within 8–15 business days (excluding weekends and public holidays). Tracking is sent when your order is handed to the delivery carrier.
7) Pre-Orders
We may offer pre-orders, typically 2–4 weeks before an official drop. Stated ship dates are estimates; standard processing generally applies after the drop date. Pre-orders are final sale and follow the same no-return policy.
8) Shipping Coverage
Current: United States and U.S. territories. We may offer international shipping in the future, in which case additional terms may apply (including customs duties/taxes and import requirements).
9) Cancellations
No cancellations: once an order is submitted, processing begins and the order cannot be canceled. Extended-delay exception: if an order has not shipped due to a processing delay exceeding six (6) weeks from purchase, you may request cancellation for a full refund prior to shipment.
10) Returns & Exchanges
ALL SALES ARE FINAL. We do not accept returns or exchanges for any reason, including sizing/fit preference, change of mind, styling preference, or accidental purchase.
11) Wrong Item Shipped (Limited Exception)
If we shipped the wrong item, email alwaysprosper.co@gmail.com within 7 days of delivery with your order number and clear photos of what you received. If confirmed, we will correct the issue — typically by sending the correct item, or by store credit/refund at our discretion if it's unavailable.
12) Carrier Delays, Lost Packages & Damage
Delivery delays caused by the shipping carrier are outside our liability — please contact the carrier first using your tracking. Once a package is handed to the carrier, risk of loss/damage transfers to the customer to the extent permitted by law. If your order arrives damaged, contact us and we will assist you in filing a claim with the carrier.
13) Shipping Restrictions
Orders cannot be shipped to locations not allowed by the U.S. government. Certain items may be subject to transportation restrictions and may require alternative shipping methods.
14) Promotions & Discount Codes
Promotions and discount codes may be modified or ended at any time. Codes are not redeemable for cash and may be subject to additional rules communicated at the time of the promotion.
15) Communications
By placing an order, you consent to receive transactional communications (order confirmation, shipping updates) via email and/or SMS. If you opt into marketing you may receive promotional email and SMS. Email opt-out: use the unsubscribe link. SMS opt-out: reply STOP.
16) Intellectual Property
All Site content — logos, designs, product names, text, graphics, photos, videos, and overall look and feel — is owned by or licensed to Always Prosper and protected by applicable intellectual property laws. You may not use, copy, reproduce, distribute, or exploit our content without written permission.
17) User Content
If you submit content (reviews, comments, photos, videos) or tag us, you represent that you have the rights to do so and grant Always Prosper a non-exclusive, worldwide, royalty-free license to use that content for brand and marketing purposes. Request removal via alwaysprosper.co@gmail.com.
18) Prohibited Conduct
You agree not to misuse the Site, engage in unlawful activity, submit fraudulent orders, interfere with Site operations, attempt unauthorized access, scrape or reverse-engineer the Site, or violate any third-party rights.
19) Disclaimer of Warranties
To the fullest extent permitted by law, the Site and products are provided 'as is' and 'as available,' without warranties of any kind, express or implied. Nothing in these Terms limits rights that cannot legally be waived.
20) Limitation of Liability
To the fullest extent permitted by law, Always Prosper will not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability for any claim relating to a purchase will not exceed the amount you paid for the product(s) at issue.
21) Indemnification
You agree to indemnify and hold harmless Always Prosper and its founders from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, violation of these Terms, or violation of any law or third-party rights.
22) Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
23) Dispute Resolution: Binding Individual Arbitration + Class Action Waiver
Disputes arising from your purchase are resolved by binding individual arbitration (AAA consumer rules), after a 30-day informal-resolution period via email. Arbitration occurs in Los Angeles County, CA (or remotely by agreement), on an individual basis only — class, collective, and representative actions are waived to the fullest extent permitted by law. Either party may bring a qualifying individual claim in small claims court. Fees follow the applicable rules and California law; mass filings may be batched under the administrator's mass-arbitration framework. If the class waiver is unenforceable for a claim, that claim proceeds in court.
24) Changes to These Terms
We may update these Terms from time to time; the Effective Date reflects the latest version. Continued use of the Site after changes constitutes acceptance.
25) Severability
If any provision is held unenforceable, the remaining provisions remain in full force and effect.
26) Entire Agreement
These Terms, together with our Privacy Policy and any policies referenced at checkout, constitute the entire agreement between you and Always Prosper regarding the Site and purchases. Questions or notices: alwaysprosper.co@gmail.com.

1) Personal Information We Collect
Identifiers and contact information (name, email, phone, addresses, account login); commercial information (order history, sizes, support history); internet/network activity via site analytics (IP, device/browser, pages viewed, interactions); approximate location derived from IP; and customer-support communications. Payments are processed by our payment providers (cards and digital wallets such as Apple Pay and Google Pay) — we do not store full card details.
2) Sources
We collect information from you (checkout, account registration, email/SMS signup, support), from your device/browser via cookies and similar technologies, and from service providers that help us operate the Site (hosting, payments, carriers).
3) How We Use It
Order processing and fulfillment, account management, customer support, site operations and analytics, security and fraud prevention, and marketing communications where you opt in.
4) How We Disclose It
Only as necessary to operate the business: our website platform and store tooling, payment processors, shipping carriers and logistics providers, and embedded communications/automation tools.
5) 'Sale' / 'Sharing' (California)
We do not sell personal information for money. Based on our current analytics/advertising setup, we do share information for cross-context behavioral advertising as defined by California law. You can opt out of sharing via the cookie controls described below.
6) Cookies & Similar Technologies
The Site uses cookies for essential functionality and analytics. You can manage cookies through your browser settings; disabling cookies may break parts of the Site.
7) Marketing Preferences
If you opt in, we may send promotional email and SMS. Unsubscribe via the email link, or reply STOP to SMS. Message and data rates may apply. Transactional messages (order confirmations, shipping updates) are still sent.
8) Data Retention
We retain personal information only as long as reasonably necessary — order records for support and recordkeeping, legal/tax compliance, fraud prevention and dispute resolution, and marketing records until you opt out.
9) Security
We use reasonable administrative, technical, and organizational safeguards. No method of transmission or storage can be guaranteed 100% secure.
10) Children's Privacy
Our Services are not intended for children under 13, and we do not knowingly collect personal information from children under 13.
11) California Privacy Rights (CCPA/CPRA)
California residents may have the right to know/access, delete, and correct personal information; to opt out of 'sale' or 'sharing'; and to non-discrimination for exercising rights. California recognizes the Global Privacy Control (GPC) as a valid opt-out signal, and we will honor valid signals where required.
12) Other U.S. States & Territories
Privacy laws vary by jurisdiction. We provide a consistent way for U.S. residents to submit privacy requests and honor them as required by applicable law.
13) How to Submit a Privacy Request
Email alwaysprosper.co@gmail.com with subject line 'Privacy Request' and include your name, the email/phone used for your account or checkout, and your request (Access / Delete / Correct). We may verify your identity before completing the request.
14) Changes to This Policy
We may update this Privacy Policy from time to time. Updates are posted on this page with a revised Effective Date.
